'Wowowee’ stampede victims happy over court decision

The families of the victims of the Wowowee stampede applauded the Supreme Court's decision to junk the petition filed by ABS-CBN Corp questioning the competence of the Department of Justice (DOJ) in handling the investigation of the February 4, 2006 tragedy. They are also planning to come up with a video documentary.

On Tuesday morning, the Supreme Court upheld the capacity of the DOJ and affirmed its jurisdiction over the case. The high court also defended DOJ Secretary Raul Gonzalez against allegations that he had prejudged the case by announcing to the media that ABS-CBN was careless in its duty to keep an eye on the possible horrible scenarios that could happen in staging such a grand event.

According to the statement issued by the Supreme Court, Gonzalez's words were not enough to make him liable of meddling in the case. Charges can now be filed against some officials of the Lopez-owned network for reckless imprudence resulting in multiple homicide and injury.

JUSTICE SERVED. The surviving victims and the families of those who perished cited the court decision as a vital step towards justice.

To mark the second anniversary of the tragic incident, the victims revealed that they are planning to come up with a video documentary to remind the people of the tragedy, which illustrates the worsening economic condition of the majority. It is also a way for them to gain more sympathy and support as they push through with their legal action against the network.

ABS-CBN remains steadfast in helping the orphans of the victims.

In the face of a looming court showdown, 71 Dreams Foundation Managing Director Fr. Tito Caluag said, "Hindi kundisyon ang pagtulong para hindi sila magsampa ng kaso. Hindi ito suhol na huwag kayo magdemanda. Hustiya 'yun, e. Hindi kami magkatunggali dito kundi magkasama."

The foundation was put up specifically to support and assist the families of the victims. "Ang tawag nga namin sa kanila hindi beneficiaries, e. Partners o katuwang dahil tinuturuan silang tumayo, hindi umasa sa doleout," continued Fr. Caluag.

It was reported that even some of those who were able to get assistance from the foundation still expressed willingness to press charges against ABS-CBN.

New primetime shows fail to dislodge GMA-7 shows

ABS-CBN launched three new primetime programs last night, January 28, to kick off their 55th anniversary celebration. These new programs are Kung Fu Kids, Lobo, and Palos. Although the numbers that these three ABS-CBN programs got based on the overnight ratings of AGB are quite high, they still failed to beat the strong lineup of existing GMA-7 primetime shows.

Among the three shows, Lobo topbilled by the tandem of Piolo Pascual and Angel Locsin had the best pilot showing with 27.7 percent, which is also the highest overall among ABS-CBN programs last night.

Lobo finished at No. 6 while its direct competitor from GMA-7, Kamandag (starring Angel's former screen partner Richard Gutierrez), rated 33.1 percent to grab the second place overall.

The action-packed Kung Fu Kids, headlined by child stars, came up with 26.6 percent on its pilot episode to place seventh overall. Kung Fu Kids went up against Kapuso network's metal hero series Zaido, which crunched 28.9 percent rating to nab the fifth spot.

Finally, the tandem of Cesar Montano and Jake Cuenca in Palos attracted 23.6 percent to take the No. 8 position. Palos had the unfortunate position of going up against the current No. 1 show, Marimar, which stood its ground by posting a 36.8 percent rating to retain its position.

Completing the Top 10 primetime programs were Coffee Prince (31.2 percent) at No. 3; 24 Oras (30.5 percent) at No. 4; TV Patrol World (23 percent) at No. 9; and Kung Ako Ikaw (14.8 percent) at No. 10. Maging Sino Ka Man just missed the winning circle with its 13.3 percent rating.

In the daytime race, Eat Bulaga! and Daisy Siete tied at No. 1 with identical 22.8 percent rating. The new Japanese drama series Hana Yori Dango 2 premiered at second place with 18.7 percent.

Meanwhile, the last episodes of ABS-CBN's Lastikman and Patayin Sa Sindak Si Barbara last Friday, January 25, also got impressive numbers. Lastikman placed fourth overall with 30.7 percent while Patayin Sa Sindak followed at No. 5 with 28.3 percent.

Marimar was still on top with 37 percent with Coffee Prince a far second with 32.3 percent; closely followed by Kamandag with 32.2 percent.

GMA-7's game show, Whammy! Push Your Luck, also had its final episode last Friday. It posted a rating of 15.5 percent to grab the fifth spot in the daytime race, behind Daisy Siete (23.8 percent), Eat Bulaga! (20.5 percent), Maging Akin Ka Lamang (17.4 percent), and My Only Love (15.7 percent).

The TV version of Ai-Ai delas Alas's hit movie, Volta, premiered last Saturday, January 26, with 20.1 percent to grab the second spot in the daytime race behind Eat Bulaga's 26.7 percent.

In the primetime race, Bitoy's Funniest Videos once again ruled the lot with 34.8 percent; followed by Kapuso Mo, Jessica Soho (33.1 percent), Kakasa Ka Ba Sa Grade 5? (26.8 percent); Imbestigador (25.9 percent); and 1 vs. 100 (19.7 percent) to complete the Top 5.

ABS-CBN's primer on their three new primetime programs—Kung Fu Kids, Lobo, and Palos—placed sixth with 17.9 percent.

Court bars ABS-CBN from presenting witness in hearing

The Quezon City Regional Trial Court on Friday barred ABS-CBN Broadcasting Corp. from presenting witnesses to support a motion for reconsideration it filed seeking the reversal of the dismissal of a damage suit it filed against AGB Nielsen Media Research (Philippines) Inc.

Branch 80 Judge Charito Gonzales junked ABS-CBN's plea to allow it to present their witnesses in order for the court to appreciate their arguments.

“We find it necessary to present our witnesses for the court’s appreciation," ABS-CBN counsel Atty. Vincent Bayhon said.

Instead, Gonzales asked the broadcasting network asked ABS-CBN to just attach their evidence to their motion for reconsideration.

AGB’s legal counsel, Francisco Rivera had opposed the request to allow witnesses for a hearing on a motion for reconsideration, saying this is not in accordance with the rules of court.

Rivera cited specific passages of court rules stating that in case of motion for reconsideration, presentation of evidence should be done by means of affidavits and not the presentation in open court.

During the hearing, the court also allowed AGB to submit its comment on ABS-CBN's motion within 10 days. ABS-CBN was then instructed to submit its reply to AGB’s comment within 5 days.

Within 5 days of ABS-CBN's reply, the court asked AGB to submit its rejoinder before the motion would be submitted for resolution.

Last Jan. 21, the ABS-CBN filed the motion asking the court to set aside its Jan. 7 order dismissing the P63-million damage suit and breach of contract it filed against AGB.

GMA Network denies ex-employee accusations

GMA Network on Thursday strongly denied the accusations made by Donard Duane L. Nojas that RGMA Bacolod hired ABS-CBN’s informant Toto Aliguin or anyone to look for panel homes in Bacolod city and that it conducted special operations to increase its ratings.

It said these accusations come from a disgruntled former employee of RGMA.

The Network said Nojas, a former program director of RGMA-AM Bacolod, was terminated on March 30, 2007 for violation of company policies, serious misconduct, gross neglect of duty, and loss of confidence.

Nojas was found guilty of sexually harassing a female station reporter and anchoring a program in a competing radio station, among other offenses against the company, it said. - GMANews.TV

GMA Network: Disparity in TV ratings is 'legitimate issue'

GMA Network on Thursday issued a statement reacting to claims made by rival network ABS-CBN on the disparity between cable and non-cable ratings of GMA Network programs.

Below is GMA Network's statement:

"Contrary to what ABS-CBN said in its statement to the press today, the disparity between cable and non-cable ratings in GMA’s programs is a legitimate issue in the move to clean up the ratings survey.

"Since 2003, GMA Network has been complaining to AGB Nielsen why the ratings of GMA Network’s programs are so low in cable TV households but so high in non-cable TV homes, a situation that does not happen in ABS-CBN’s programs.

"It is to be noted that when GMA Network was not a strong competitor of ABS-CBN, the cable and non-cable ratings of both GMA and ABS-CBN consistently exhibited a normal behavior in the past.

"The abnormal ratings behavior of GMA’s programs in cable TV homes started to happen only when GMA Network began to compete head-on with its rival station five years ago and when GMA Network began to beat ABS-CBN in Mega Manila TV ratings. At that time, AGB and Nielsen were providing separate ratings for TV programs. And the cable ratings disparity happened only in the AGB results and not in Nielsen’s. In 2005, AGB and Nielsen merged their TV ratings services in the Philippines.

"ABS-CBN said in its official position paper that it presented to the trade in 2006 that the reason for their high cable ratings was that 'among cable homes, the connection through cable takes away the vulnerability of ABS-CBN’s reception from noise, especially in instances when ABS-CBN is assigned to a channel 8.' ABS-CBN was referring to the movement of their cable channel assignment from channel 6 to 8. GMA Network consulted with a third party technical expert to seek his opinion on that claim and the following was what he said:

"'No VHF (Very High Frequency) be it low, mid, or high-band is immune or not susceptible to interference, thus making it imperative for the cable industry in the present to undergo a study to ascertain that a channel is 'clean' enough to be operated in.'

"Engineering surveys conducted have also yielded that interference varies in different portions of Metro Manila. It is on the Cable provider’s shoulders to limit amplifier cascades to attain a decent carrier to noise ratio resulting in better picture quality.

"In summary, the Cable television provider and its engineers are the ones responsible in seeing to it that a specific Cable television channel is clean enough for a commercial television station to operate in, thus making everyone operate on a level playing field.

"ABS-CBN did not reply to the rebuttal made by the expert consulted by GMA Network. After a long silence, ABS-CBN now says that the disparity between cable and non-cable ratings is due to their reception problems on Free TV and that these problems are eliminated on cable TV where their signal is clear. GMA Network believes that the highly erratic or fluctuating behavior of ABS-CBN’s cable ratings, particularly in the suburbs, cannot be logically attributed to their clear cable TV signal.

"It is not true that GMA’s complaints of interference in cable TV have no basis because GMA has received thousands of complaints of signal distortion and degradation from Sky and Home Cable subscribers who have executed affidavits. The complaints ranged from snowy and/or blurry to black and white reception; wavy/shadowy image; zigzag/moving/diagonal/vertical/horizontal lines; noisy/distorted video; weak audio; and weak or no signal. These complaints prompted GMA Network to file a case before the NTC, where it is now pending.

"It is a fact that GMA Network’s competitor owns and/or controls the dominant cable operators in the country. Thus, it is the one who has both the means and opportunity to know where the people meters are installed by AGB Nielsen among cable TV homes.

"Until now, AGB Nielsen has not provided a satisfactory explanation to the highly illogical, very low cable ratings of GMA’s programs as compared to the unusual and unexplainable very high cable ratings of ABS-CBN’s programs. "

Judge in ratings row inhibits self

The judge tasked to handle the controversial case between GMA Network and ABS-CBN on Thursday inhibited himself from the case for having a relative employed in one of the networks.

Judge Samuel Gaerlan, of Branch 92 of the Quezon City Regional Trial Court, reportedly asked to be removed from the case because one of ABS-CBN’s corporate lawyers, Marifel Gaerlan-Cruz, is his first cousin.

Before the start of the hearing on the motion for the issuance of a temporary restraining order (TRO) last Tuesday, Judge Gaerlan disclosed to both parties his relationship to Cruz and sought the comments of the legal counsels of ABS-CBN and GMA 7.

Lawyer Gener Asuncion, head counsel for GMA, said the honorable judge could proceed with the hearing of the case since he did not find any reason for the court not to proceed hearing the case. Lawyer Regis Puno, legal counsel for ABS-CBN, however, insisted on asking the judge to inhibit from the case for the interest of justice.

In his three-page order, Judge Gaerlan cited the Rule on Disqualification of Judicial Officers wherein it stated the grounds for which the presiding judge is legally disqualified from sitting in a case.

“In the situation at hand, the undersigned is related not to the counsel handling the case but to one of the many lawyers in the legal department of the defendants (ABS-CBN). Yet, even if no legal disqualification applies, it is very possible that to the public eye, a conflict of interest appears. This is so considering the prevailing attention directed on the case by the mere fact that the parties are prominent players in the media industry," Judge Gaerlan said.

GMA 7 had filed a P15-million damage suit and the motion for the issuance of TRO against ABS-CBN to stop the airing of news related to the issue of alleged tampering in the ratings data released by AGB-Nielsen Media Research Philippines.

Lawyer Gener Asuncion, head counsel for GMA-7, expressed disappointment over the development, saying the delay could only mean ABS-CBN can go on airing malicious statements against his client.

“We are asking for a TRO to stop the ABS-CBN from airing defamatory statements against GMA 7. We could have presented our evidence and the evidence of the defendants if not for the inhibition of the judge. I don’t know if they will continue to air said statements although they are aware of the case. But it would appear that they would continue," Asuncion said.

The said defamatory statements against GMA Network were aired on various TV programs of ABS-CBN on January 5, 6, 7 and 12 using an additional medium, convenient witnesses which it procured, pointing at GMA as persistently manipulating TV ratings in the cities of Cebu, Davao and Iloilo.

AGB report says ABS-CBN also contacted panel homes during promos – GMA Network

GMA Network said that according to AGB Nielsen’s Data Review on the panel intervention issue released on January 15, 2008, ABS-CBN also contacted metered homes during their promotional activities in the Visayas and Mindanao.

Based on the audit findings of AGB Nielsen, ABS-CBN’s promotional activities included offering 300 pesos cash monthly as well as groceries in exchange for loyal viewing of ABS-CBN shows.

ABS-CBN, according to the AGB report, also entered panel homes to “check signal clarity in exchange for gift offering."

GMA Network said it was even stated in the AGB report that, “A panel home member was being persistently asked that the AGB Nielsen meter be showed to them (ABS-CBN representative). The panel home member refused."

AGB Nielsen said that they have excluded the exposed panels from the official ratings data and that viewing levels did not significantly change after the exclusion of the said panels. “Channels shares with respect to ABS-CBN, GMA and other channels remain after the comparison between the original and re-processed data was done," AGB said.

AGB Nielsen also said that their coincidental survey confirmed that viewing trends/patterns for primetime and early evening blocks were consistent with Panel data in relation to GMA, ABS-CBN and overall viewing levels.

“Expected drops in average minutes for GMA and increases for ABS-CBN did not conform to actual observed average viewing minutes after contacted homes have been excluded," AGB Nielsen said.

The AGB report, according to GMA Network, only shows how ABS-CBN has been attempting to confuse the public through the airing of false and distorted statements, which aims to portray ABS-CBN as an innocent victim of the alleged ratings manipulation.

GMA Network said that ABS-CBN never mentioned in their statements and news reports that they, too, were conducting field promotional and other activities in the regions, which, based on the AGB report exposed some panel homes to ABS-CBN.

Instead, ABS-CBN has been consistently broadcasting - what GMA Network strongly says to be – erroneous and malicious allegations on the manipulation of ratings in the regions.

ABS-CBN’s informants claimed that GMA Network hired them to look for and bribe panel homes in Bacolod City. A few more alleged informants from Cebu, Davao, and Iloilo were also interviewed by ABS-CBN.

DTI sues ABS-CBN over ‘Wowowee’ game mess

The Department of Trade and Industry (DTI) has filed administrative charges against ABS-CBN Broadcasting Corporation, after it found irregularities in the "Wilyonaryo" segment of the firm’s noontime show "Wowowee".

GMA Network’s 24 Oras on Tuesday reported that the DTI-National Capital Region's Area 3 based its complaint on the results of the investigation conducted by a panel led by a bureau under the department.

DTI-NCR’s Area 3 has jurisdiction over ABS-CBN, which is located in Quezon City.

Assistant Secretary Angel Pelayo, DTI-NCR director, said the agency would wait for ABS-CBN’s reply to the charges.

DTI-NCR, which serves as the court in the case, gave ABS-CBN 10 days to answer the charges.
“Noong January 11, nagsampa ng formal charge ang Area 3 director ng DTI-NCR sa opisina ko, and the formal charge is versus ABS-CBN Broadcasting Corp. Nag-send na ng summons, and we are waiting for their reply," Pelayo said

DTI-NCR, which serves as the court in the case, gave ABS-CBN 10 days to answer the charges.

The department, however, refused to give other details on the charges and the recommendation of the fact-finding panel.

The controversial "Wowowee" segment happened on August 2007.

DTI created the fact-finding panel on September 13, 2007.

The panel is composed of the Consumer Welfare Trade Regulation Group, the DTI’s Bureau of Trade Regulation Consumer Protection, representatives from the Movie Television Review and Classification Board, Kapisanan ng mga Brodkaster ng Pilipinas, and a consumer group.

The panel released its recommendations last November 9, after a two-month investigation.

In a statement, ABS-CBN said it was extremely disappointed with DTI's charges.

“ABS-CBN categorically denies any wrongdoing or violation of law. ABS-CBN is reiterates…there was a design flaw in the wheels but there was never any intention to gain any advantage over contestants or control the outcome of the contests. ABS-CBN will answer the charges and is confident that it will be absolved of any liability." gmanews.tv

ABS-CBN informant shows face to media, sticks to rigging claims

The informant of ABS-CBN Broadcasting Corp. on Tuesday revealed himself to the media and reiterated his claims that GMA Network Inc. and polling firm AGB Nielsen conducted manipulation of TV ratings in Bacolod, Iloilo.

GMA Network has repeatedly denied these claims, and has filed a P15-million civil action suit against ABS-CBN for airing what it says are false and malicious claims.

In a press conference held by ABS-CBN, Mark Dumago, 23 years old, who works as a field coordinator of a Bacolod radio station, said an official of GMA Network's radio station in Bacolod approached him in 2006 to conduct a survey on what TV shows were watched by local residents and which station had the highest ratings.

Dumago said their activities had the blessing of GMA Network's Manila office. However, he declined to disclose the name of the official who contacted them, or of the GMA Network executive in Manila who "blessed" their operation. He said he would only reveal their names in court.

"We know that they will deny engaging our services because of the nature of our work was confidential," he said.

The informant said that they were tapped to do the job because of their experience in doing surveys for some radio stations as field coordinators. Two months after, he said they were given a new assignment -- to locate households with installed AGN Nielsen TV meters.

Dumago said he received a monthly salary of P6,200 and P115 cellphone load for his new assignment adding that they allegedly bribed each panel home to watch GMA-7 programs in exchange of P500 plus monthly groceries.

"Many accepted our offer. They can't risk to tell what we are doing to AGB because their money and monthly groceries will be gone," Dumago said.

Dumago also claimed operations similar to theirs were also being done in Davao, Cebu and Iloilo, but did not clarify as to how he came to know about activities in other cities. - GMANews.TV

AGB Nielsen hiniling sa korte na i-contempt ang ABS-CBN

Hiniling ng AGB Nielsen Media Research (Philippines), Inc. sa korte nitong Martes na kasuhan ng contempt ang ABS-CBN Network dahil sa pagbabaluktot ng impormasyon ukol sa umano’y pandaraya sa TV ratings.

Una rito, ibinasura ng Quezon City Regional Trial Court (QCRTC) nitong Lunes ang P63-milyong demanda na isinampa ng ABS-CBN Broadcasting Company laban sa AGB Nielsen na inakusahang lumabag sa kanilang kontrata.

Isinaad ni Francisco Rivera, abogado ng AGB Nielsen, sa petisyon na nagkamali ang ABS-CBN sa paglalabas sa telebisyon ng mga bahagi ng naunang utos ng korte kung saan ipinakitang kailangang itigil ng AGB ang kanilang “TAM (television audience measurement) data gathering activities."

“Instead of being accurate in its reporting, the ABS-CBN abused its clout as a broadcaster to engage in an intense media campaign to publicly vilify the petitioner (AGB Nielsen) and gain public sympathy for its cause, evidently to advance its private interest as litigant," pahayag ng AGB Nielsen.

Iginiit ng AGB Nielsen na sa ilang graphics ng ABS-CBN na ipinakita sa iba’t-iba nitong programa, tinanggal ang bahagi sa utos ng korte kung saan ipinatatanggal lamang sa kanilang survey ang mga “corrupted home panels" at hindi ang kabuuan nilang “data-gathering and data-delivery services."

Tinukoy ng AGB na lumabas ang naturang graphics sa programa ng ABS-CBN na Bandila noong Disyembre 20 at Umagang Kay Ganda noong Dis. 21.

Kinuha ng AGB ang impormasyon mula sa utos ni QCRTC Branch 80 Judge Charito Gonzales noong Dis. 20 na kinatigan ang temporary restraining order na hinihiling ng ABS-CBN.

“The insertion of an ellipsis (…) in place of the qualifying phrase in respondent’s graphics misrepresents the contents and the import of the court order. Respondent (ABS-CBN) is not ignorant of the meaning of the qualifying phrase considering that it is found in paragraph 4.4 and the prayer of its own complaint," giit ng AGB Nielsen tungkol sa P63-million damage suit ng ABS-CBN.

Ayon pa sa AGB Nielsen, na bukod sa maling interpretasyon sa utos ng korte, inakusahan din ng ABS-CBN ang kumpanya ng paglabag sa utos ni Judge Gonzales. Ang mga naturang akusasyon ay ipinasahimpapawid pa ng ABS sa mga programang Bandila (Dis. 21) at the Buzz (Dis. 23) noong nakaraang taon.

Nanindigan ang AGB na hindi nila nilabag ang kundisyon ng korte sapagkat itinigil na nila ang pagkuha ng datos mula sa mga corrupted home panel at hindi rin sila naglabas ng datos mula sa mga nasabing kabahayan.

Nakasaad sa petisyon ng AGB Nielsen na may karapatan sila sa patas na paglilitis sa korte na hindi naiimpluwensiyahan ng publiko.

Sinabi ng AGB na hindi lamang lumabag sa sub judice rule ang ABS-CBN kundi inilagay din sa alanganin ang integridad ng judicial proceeding sa Branch 80 ng QCRTC.

“Respect for due process and the orderly administration of justice, the petitioner prayed that the respondent be declared in contempt and punished accordingly," ayon sa AGB. - Mark J. Ubalde, GMANews.TV
